Section 1. Introduction & Acceptance of Terms

1.1 Binding Agreement

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THIS IS A BINDING LEGAL CONTRACT.

Welcome to the services operated by FUCONNECT PTE. LTD. (together with its affiliates, “FUCONNECT”, “we”, “us”, or “our”), consisting of its network of websites, software applications, and any other products or services offered by FUCONNECT (collectively, the “FunUp Services” or “Services”). Other services offered by FUCONNECT may be subject to separate terms.

1.2 Acceptance of Terms

By accessing, downloading, or using the FunUp Services, you agree to be bound by these Terms of Service, along with any additional posted guidelines, policies, or rules applicable to specific features and services (the “Guidelines”), as well as our Privacy Policy, all of which are incorporated herein by reference. If you do not agree to these Terms of Service or the Privacy Policy, you must immediately cease accessing or using the FunUp Services.

1.3 Content Exposure & Waiver

You understand and acknowledge that when using the FunUp Services, you will be exposed to content from a variety of sources, and that FUCONNECT is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such content. You further acknowledge that you may be exposed to content that is inaccurate, indecent, or objectionable. To the fullest extent permitted by law, you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against the FunUp Services and FUCONNECT regarding such content exposure.

1.4 Eligibility & Geographic Restrictions

We do not accept payments or conduct business with individuals or entities located in Cuba,Ukraine, Iran, North Korea, Sudan, Syria, the Crimean region, DNR, LNR, or Russia. If you are located in or a resident of such regions, you are strictly prohibited from using the FunUp Services. Furthermore, due to technical restrictions or regulatory policies, FunUp Services may not be available in certain countries or regions.

1.5 Modifications to the Terms

We reserve the right to amend these Terms from time to time—for instance, when updating functionality, combining multiple apps/services, or adapting to regulatory changes. We will use commercially reasonable efforts to notify users of material changes (e.g., via a notice on our platform). You should review these Terms regularly. The “Newest Updated” date at the top reflects the effective date of the current version. Your continued access to or use of the Services after the effective date of revised Terms constitutes your binding acceptance of the new Terms.

Section 2. Your Account with Us

2.1 Account Registration & Confidentiality

To access or use certain features of the Services, you must create an account. When registering, you must provide accurate, complete, and up-to-date information (such as your mobile phone number). You are responsible for maintaining and promptly updating your account details.

You must keep your account credentials strictly confidential and shall not disclose, lend, or transfer your password or account details to any third party. We strongly recommend safeguarding your devices, avoiding saving login info on public devices, and logging out after each session.

2.2 Username Restrictions

When creating an account or username, you agree not to use vulgar, offensive, or inappropriate names, including but not limited to:

• Real names, pseudonyms, or aliases of state leaders or public figures;
• Names of government agencies or official institutions;
• Uncivil, discriminatory, insulting, or obscene language;
• Any names that cause ambiguity, misunderstanding, or violate applicable laws and regulations.

FUCONNECT reserves the right to modify or terminate any account information that violates these restrictions.

2.3 Account Security & Liability

You assume full legal responsibility for all activities occurring under your account (including posting content, executing transactions, and performing interactive operations), whether authorized by you or not. If you discover or suspect unauthorized access or compromised credentials, notify us immediately at funupkf@gmail.com. You shall be solely responsible for losses resulting from your failure to notify us in a timely manner. While FUCONNECT is not liable for losses arising from your failure to safeguard your account, you agree to fully indemnify FUCONNECT and other users for any losses caused by non-compliant or unauthorized use of your account.

2.4 Account Restrictions, Suspension & Disposal

You may not buy, sell, rent, lease, or transfer your account, nor use it for unlawful transactions. FUCONNECT reserves the right to handle, restrict, or terminate your account at any time for legitimate reasons without prior notice, including if we determine that you have violated these Terms, engaged in non-compliant activities, or infringed upon third-party rights.

2.5 Account Deletion

If you wish to delete your account, contact us at funupservice@gmail.com. Before requesting account deletion, you must independently resolve all virtual assets and associated rights. FUCONNECT assumes no liability for asset losses resulting from account deletion. Once deleted, your account cannot be reactivated, and all associated data, content, and virtual assets will be permanently unrecoverable. We reserve the right to reject deletion requests if your account has outstanding debts, ongoing legal disputes, or unresolved compliance matters.

Section 3. Accessing Services & Regional Structure

3.1 Device & Network Requirements

If you use FunUp Services over mobile networks or interact with third-party providers, your carrier’s standard rates and data fees will apply. You represent that all payment and account information provided to us or our third-party service providers is accurate and current.

3.2 Third-Party Authentication

FunUp Services may permit you to register and log in via third-party platforms. The collection, use, and disclosure of your data by such third parties are governed by their respective privacy policies.

3.3 FunUp offers specialized operational zones based on different countries and regions (each, a “Zone”). Each Zone targets specific language preferences and provides tailored content, localized interfaces, and region-specific pricing strategies.Zone Selection: Upon initial login, we predict your language preference based on your device settings and automatically assign a default Zone. Creating an account in one Zone restricts your access to that specific Zone, you cannot access contents or transfer account assets across different Zones.

Section 4. Paid Services & Virtual Assets

4.1 Certain features within FunUp Services require monetary payment (“Paid Services”). Access to Paid Services is conditional upon your confirmation and successful payment of applicable charges. We reserve the right to charge fees, modify pricing, or adjust free/paid service offerings at any time at our sole discretion without liability to you.

4.2 Paid Services may be purchased using credit/debit cards or other localized payment methods, processed through third-party Internet payment service providers(like Apple Pay, Google Pay). By making a purchase, you agree to comply with such third parties’ terms and conditions and privacy policies. IF YOU DO NOT AGREE TO THIRD-PARTY PAYMENT TERMS, DO NOT PURCHASE PAID SERVICES.

4.3 ALL PAYMENTS ARE NON-REFUNDABLE, AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS.

4.4 Purchased Paid Services and virtual items (e.g., virtual coins, gifts):

• Have no monetary value and do not constitute legal tender, real-world currency, or stored-value property.
• May never be sold, transferred, traded, or exchanged for fiat currency or real-world value outside the platform.
• Grant you only a limited, revocable, personal, non-transferable, and non-sublicensable license to use within FunUp Services.

Section 5. User Generated Content (“UGC”)

Unless otherwise agreed in a separate written contract signed by FUCONNECT, by broadcasting, publishing, posting, submitting, or uploading any UGC on or through FunUp Services, you grant FUCONNECT and its sublicensees a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, fully sublicensable license to use, copy, modify, adapt, publish, translate, edit, create derivative works from, distribute, perform, and publicly display such UGC (in whole or in part) in any media or technology now known or hereafter developed.

You are solely responsible for your UGC and the consequences of posting or publishing it. You represent and warrant that:

• You own or have obtained all necessary rights, licenses, and permissions from legal owners to post such UGC and grant the licenses herein;
• Your UGC does not contain third-party copyrighted material or proprietary rights unless legally authorized.

You are solely responsible for all User Generated Content (“UGC”) that you upload, post, stream, transmit, publish, or otherwise make available through the FunUp Services. You explicitly represent and warrant that your UGC strictly complies with the following content standards. You shall not upload, stream, post, transmit, or share any UGC that contains or promotes:

• Any content involving Child Sexual Abuse Material (CSAM), Child Sexual Exploitation and Abuse (CSAE), child pornography, or sexualized depictions/exploitation of minors. FUCONNECT maintains a strict zero-tolerance policy against CSAM/CSAE and will immediately terminate violating accounts and report all relevant account details and evidence to law enforcement agencies and international child protection organizations.
• Content that promotes, incites, or depicts extreme violence, terrorism, or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; or content that harasses, bullies, stalks, threatens, intimidates, embarrasses, or distresses any person.
• Content that is sexually explicit, pornographic, obscene, crude, offensive, inflammatory, or indecent.
• Defamatory, libellous, or deceptive content; or content that discloses or exposes private personal information of third parties (such as phone numbers, residential addresses, national identification numbers, passport details, credit card numbers, or financial information) without explicit legal authorization.
• Content that constitutes, encourages, instructs, or promotes suicide, self-harm, dangerous stunts, illegal acts, or severe criminal offenses.
• Content that infringes or misappropriates any copyright, trademark, patent, trade secret, moral right, privacy right, or other proprietary rights of any third party.
• Content that spreads fraudulent information, deliberate deception, fake reviews, or unauthorized medical/legal/financial advice that may cause physical, reputational, or financial harm.
• Any other content that FUCONNECT, in its sole and absolute discretion, deems objectionable, inappropriate, unethical, or detrimental to community safety, or which may expose FUCONNECT, its affiliates, the Services, or its users to risk of harm, legal loss, or liability of any type.

If any UGC posted or transmitted by you violates these standards, FUCONNECT reserves the right to immediately remove or block the non-compliant content, restrict your posting privileges, suspend or ban your account without prior notice, and cooperate fully with competent authorities.

FUCONNECT does not endorse, verify, or guarantee the legality, accuracy, safety, or quality of any UGC, opinion, recommendation, or advice expressed by users. FUCONNECT expressly disclaims any and all liability in connection with UGC. Although we reserve the right to review UGC, we are under no obligation to pre-screen or monitor user contributions.

Section 6. Prohibited User Conduct

You agree to use the Services strictly in accordance with all applicable laws, regulations, and these Terms. When accessing or using the FunUp Services, you shall not, directly or indirectly, perform or permit any third party to perform any of the following prohibited technical, operational, or system-level actions:

• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, extract, or attempt to derive any source code, algorithms, underlying methods, or proprietary techniques from the Services or any portion thereof.
• Distribute, sell, license, sub-license, lease, rent, or otherwise commercially exploit any part of the Services or derivative works without our express prior written consent.
• Use automated scripts, spiders, bots, plugins, add-ons, or any unauthorized technical tools to collect platform data, scrape content, maliciously farm rewards/points, or exploit technical vulnerabilities (including but not limited to bulk account registration and fraudulent transactions).
• Disrupt or interfere with the proper working of the Services, overload servers, bypass or circumvent any security measures, authentication mechanisms, or access restrictions, or introduce viruses, Trojans, worms, logic bombs, or other malicious code.
• Use the Services to send unauthorized commercial advertisements, promotional materials, pyramid scheme solicitations, or spamming communications.
• Impersonate any natural person, entity, corporate body, or official, or misrepresent your true identity, age, or affiliation with any person or entity.
• Offer professional advice, analysis, or recommendations (including legal, financial, investment, or medical advice) without holding proper licenses and qualifications required by law.
• Engage in any other conduct or technical manipulation that FUCONNECT, in its sole and absolute discretion, determines to be detrimental, improper, contrary to public order or good morals, or harmful to the operations, security, reputation, or legal interests of FUCONNECT, the Services, or any third party.

Section 7. Content Review, Reporting & Enforcement

7.1 Zero-Tolerance Policy & Moderation Discretion

FUCONNECT enforces a zero-tolerance policy against objectionable content and abusive conduct. To the maximum extent permitted by law, FUCONNECT reserves full discretion to maintain platform safety and order by reviewing, removing, blocking, or modifying any UGC at any time without prior notice or liability.

7.2 In-App Safety Tools (Blocking & Reporting)

To foster a safe community environment, FunUp provides intuitive in-app features:

• User Blocking: You can block any user at any time. Once blocked, you will no longer receive messages or see content from that user.
• Content Reporting: If you encounter violating or objectionable UGC, you may submit a report via the in-app “Report” button or email customer support at funupservice@gmail.com  with detailed links and evidence.

7.3 Review & Enforcement Timelines

We aim to review reported content and accounts within 1 to 3 business days upon receiving a valid report. Depending on the severity of the violation, we may take enforcement measures, including issuing warnings, deleting non-compliant content, restricting feature access (e.g., commenting or messaging), or temporarily/permanently banning accounts.

7.4 Automated Safety Scanning

Our automated systems may analyze content you transmit to identify spam, intercept malware, detect security risks, and ensure regulatory compliance. This analysis occurs automatically during content transmission and storage.

7.5 Appeals Mechanism

If you object to a moderation decision or account penalty, you may submit an appeal within five (5) days of notification by contacting funupservice@gmail.com. We will review your appeal and notify you of the result within 5-7 business days.

Section 8. Intellectual Property & Licenses

8.1 Ownership of Platform Works

All websites, software, interface designs, graphics, materials, and digital assets provided through FunUp Services (collectively, “Our Works”) are owned, created, or licensed by FUCONNECT. Our Works are protected by international copyright, trademark, patent, trade secret, and intellectual property laws.

8.2 Limited Personal License

Subject to your full compliance with these Terms, FUCONNECT grants you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to access and use the FunUp Services strictly for your personal, non-commercial use. Any unauthorized copying, distribution, modification, or reverse engineering of Our Works is strictly prohibited and will result in immediate license termination.

8.3 Digital Rights Management (DRM)

Content on FunUp Services may be protected by DRM technologies. You agree not to circumvent, disable, remove, or tamper with any DRM mechanisms implemented within the platform.

8.4 Copyright Infringement Notice (DMCA / IP Policy)

FUCONNECT respects intellectual property rights. If you believe any content hosted on FunUp Services infringes your copyright, please submit a written notification to funupservice@gmail.com containing detailed evidence of ownership and the specific location of the infringing content.

8.5 Open Source Software

FunUp Services may incorporate third-party open-source software modules. You can review attribution details and contributor notices in the platform’s Open Source Software Information List.

Section 9. Disclaimers & Limitation of Liability

9.1 Disclaimer of Warranties

THE FUNUP SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FUCONNECT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUCONNECT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.3 Limitation of Aggregate Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF FUCONNECT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICES OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL BE LIMITED AS FOLLOWS:A）IF YOU HAVE PURCHASED OR USED ANY PAID SERVICES: THE AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED US DOLLARS; B) IF YOU HAVE NOT PURCHASED OR USED ANY PAID SERVICES: THE AGGREGATE LIABILITY SHALL NOT EXCEED TEN US DOLLARS.

Section 10. Indemnification & Miscellaneous

10.1 Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FUCONNECT, its parent corporation, affiliates, licensors, service providers, officers, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms or applicable laws;
• Any UGC submitted, posted, or transmitted by you;
• Your misuse of the FunUp Services or infringement of any third-party rights.

10.2 Governing Law & Jurisdiction

These Terms of Service, their subject matter, and their formation shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law. Any dispute, controversy, claim, or difference arising out of or in connection with these Terms or the use of FunUp Services, including any question regarding their existence, validity, or termination, shall be submitted to and finally resolved by the exclusive jurisdiction of the courts of Singapore.

10.3 Severability & Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

10.4 Entire Agreement

These Terms, together with the Privacy Policy and any applicable Guidelines, constitute the entire legal agreement between you and FUCONNECT regarding your use of the FunUp Services, superseding all prior communications or agreements.
